TOKYO, Japan - Despitre facing new charges former Nissan Chairman Carlos Ghosn is to be released from jail.

The Tokyo District Court court ordered the release on Wednesday after bail was set at ¥500 million ($4.5million).

The 65-year old Ghosn was first arrested in November but was released from prison last month on $9 million bail. He was then arrested on a new charge and detained once more.

On Monday he was facing a raft of new charges, including one for aggravated breach of trust, aimed to keep him in prison. Specifically, he is accused of expropriating a Nissan subsidiary’s payments to a distributor in Oman, according to The Japan Times. Prosecutors claim part of the money, about ¥560 million, had been sent to Good Faith Investments, a Lebanese firm he effectively controlled, for his own interest.

While in court Ghosn's lawyers applied for their client to be released on bail. The application was granted on Wednesday. The former Nissan boss is likely to be released on Thursday.

The Japan Times, quoting legal experts, said rearresting an individual who had been released on bail was a highly unusual move.
